I think the hospital treatment and resultant operation required would over rule the 8 day technicality You can make a quick phone call to the HSE and ask them for their thoughts on that

Luckily I'm in a union, so they are going to try to help. Got my pack through the door today with regards to the forthcoming hearing. Interestingly they have changed the reason for suspension from gross misconduct to act of dishonesty regarding the incident. Both letters are supposed to be copies of each other but the wording has been changed on the latest one.
