That's a pretty serious case of abusive powers if thats what was said. I certainly think that a Section 59 is easily misused, and to target road users in place of proving an offence is wrong, but without the option to appeal too is apauling. I also dont think that a vauge statement of opinion (without proof) would stand up in court, but by then it may be too late. Is there no way to simply refuse the Section 59 on the spot, as you can simply opt to go to court with any other form of ticket. My thought there being that if you were speeding thats what you would be done for, if you were driving without due care then thats what you would be done for, if you carve someone up then thats what you would be done for, but if non of these can be proved then surely theres no evidence to substantiate a Section 59 either!!!
Like i've been saying for years we are slowely becoming a policed state, and there are to many police out there that abuse their badge. Last year i was following a normal corsa and the prat could not drive and after he nearly caused an accident i got out of my car gave him a few choice words and told him he shouldn't be on the road so what did he do? He pulled out a badge and said "police offcer calm down before i nick you!" then when i told him it's police officers like him that hide behind their badges that give old bill a bad name he wasn't very happy. At the same time i have met some police officers that are as normal as you and i, i used to know a copper that rode himself and always said at the end of the day it's just a job, when he takes the uniform of he just like the rest of us.
Guess what boys ??? Mine and Soonbedeads year under section 59 has passed.Feck it the blade is aving it on wednesday night.Not that it ever slowed me down anyway. Soonbedead nearly lost his bike last wednesday pulling a dirty great wheelie then put it down and a copper passes us oncoming.Very lucky boy.

Ive always wondered what would happen if police caught you sitting it on the back wheel? Nearly been close a couple of times, couldnt you just argue that youd selected the wrong gear and accelerated?
Section 59's are a little bit subjective and dependant on what guidance if any a force gives its officers. TBH Tyke pulling a wheelie and making an excuse like the wrong gear being selected is probably only going to make matters worse. I'd just take it on the chin and be thankful I'm not reported for dangerous driving or undue care and attention.
I can hear it now............ "Have you or any other persons mentioned on the policy had insurance refused or cancelled in the last 5 years?" "Have you had any accidents, claims or convictions regardless of fault in the last 5 years?" "Have you got any outstanding section 59 warnings against you??"
Don't they also ask if you've got any pending or unspent motoring offences??? I'd be pleading ignorance right there lol
SECTION 59 OF THE POLICE REFORM ACT - ANTI SOCIAL DRIVING OFFENCES New laws in respect of certain anti social driving offences can now be dealt with by Section 59 of the Police Reform Act. Basically what that means is if you are seen: Driving in a careless or inconsiderate manner Driving on common land, a footpath or bridle way or any land which is not part of a road Driving in a manner which is causing/has been causing, or is likely to cause alarm, distress or annoyance to members of the public. Then a Section 59 warning can be issued to you. This warning is placed against both the driver and the vehicle and lasts for 12 months. If the driver of the vehicle or the vehicle with the warning issued to it is then seen driving in any of those conditions again in the next 12 months the vehicle can be seized and, if not collected after paying for recovery and storage costs, it will be crushed. Please note that this relates to either the driver with the Section 59 or the vehicle. oh mate - are you kidding me ?? the cop black marked the blade too ? thats hilarious and the second part here (above) reads like the driver can be crushed or their vehicle if they dont pay the fine - unbelievable and you also have to put up with number plates the size of mac trucks - well, all i can say is congratulations to you and your vehicle for having above standard anti social behaviour.
When I renewed my insurance I did ask about section 59s, they had never even heard of it.Convictions on your licence only was the reply.
