Trade mark Infringment question

    Any one advise on this the video I put up last night which was a link to YouTube for the watchdog program on Limobroker . They have the word" l** bro** "as a registered trademark .I used this in my introduction of the video "anyone using a **** company "do they have grounds for copy right infringement , here is there email sent me .

    We have spotted a video and content on your website which is a registered trademark, see link: Intellectual Property Office - By number results



    If this isn't removed within 24 hours we will be claiming damages for trademark infringement.

    No expert mate but Bruce got caught out with this, if they are right, then take it down! Can get yourself in all sorts of bother.

    That said, the video is a link from YouTube so that's fine I would think, so all you have to do us take out "li** *****" in your title.

    Just re workd it and they can't do naff all surely!?

    I have not heard this one before But just in case for your sake and the forum have edited this just in case

    I did not see the program or know anything about this But better be on the safe side and not mention the company by name

    Sorry all I can suggest. I have edited the other thread so this is sorted with

    You have not infringed their copyright, all you have done is post a link to a youtube video. This can aslo be found on BBC iPlayer. They are just threatening you to take it down so peeps don't get to see it (crap quality anyway).

    i dont think they were citing the youtube video mate, just the title of Jason's description which they state is their trademark. remove that and surely they cant do anything? like i say, not an expert at at.... could be wrong, it has been known! lol

    be interested to see how they used the term on the bbc i player jase - sure if you copied that its fine.

    Think on bbc iplayer it will just come under the general heading of watchdog as the piece about stretched vehicles isnt a programme in its own right, so theres nowt this company can do and are they really gonna take in the bbc with all its invgstigative journalist power, prob find even more malpractice, however im assuming here, im sure all stretched vehcles companies offer a service that is second to none :)

    Limobroker is not the same as Limo Broker ;) EDIT >> Forget that they registered Limobroker too :(

    Think they are chancing it and relying on people running scared. You could always contact Watchdog about this.

    What is trade mark infringement?
    If you use an identical or similar trade mark for identical or similar goods and services to a registered trade mark - you may be infringing the registered mark if your use creates a likelihood of confusion on the part of the public.

    This includes the case where because of the similarities between the marks the public are led to the mistaken belief that the trade marks, although different, identify the goods or services of one and the same trader.

    Where the registered mark has a significant reputation, infringement may also arise from the use of the same or a similar mark which, although not causing confusion, damages or takes unfair advantage of the reputation of the registered mark.

    This can occasionally arise from the use of the same or similar mark for goods or services which are dissimilar to those covered by the registration of the registered mark.
