I think that is an exceptionally bad business practice to go back on a deal. Did they place anything in writing on the p/x price ? I thought the law stated a contract can be verbal or written, but maybe I am mistaken.

I just think it's disgusting mate. I really hope you manage to get one from another dealer.

Did you shake hands on it ??....I'm pretty sure in law that a handshake on a deal is a binding contract...

The cynic in me suggests that 10k is a very strong trade in figure, so that would mean the dealer discounting the SP, which makes no sense if they are selling as well as people think. In fact, I think 9k is an exceptional trade in figure.

No signed order form? Any conversation may aswell not have happened.

Bad form from the dealer? Perhaps, but they are a business, not a mate.

I have done a bit of Law of Contract but I am no lawyer.

A verbal contract is enforceable but involves “consideration”. Consideration being the value of the contract. A promise does not have “value” on both sides and is not enforceable.
    ie:
They said they would give you the motorcycle foc = Promise
They agreed to sell you a motorcycle, and you are giving them your old motorcycle and some cash in return = Contact

The problem you have is proving it, did you have anyone witness the contract? Are they admitting they are withdrawing the contract or just denying it ever existed?

I would suggest you try and engineer a discussion with the dealer and try and get them admit they are withdrawing what they have already agreed but making sure the conversation is witnessed, preferably by someone independent.

If you manage to do that the next stage would be to formally write to the dealership informing them that you wish them to honour the “contract” and that you have an independent witness and are prepared to take it to a lawyer, Honda UK and the motorcycle press. Give them a reasonable period of time, ie 7 or 14 days to respond in writing.

Good luck but it’s a tough one, and it could cost you more than the grand to peruse it through the courts.

Don’t take my word for it; get some proper and more importantly up to date advice from someone who really knows this kind of stuff. CAB might be a good place to start.

Don't get me wrong Graeme, I hope you get it sorted.

All I'm saying is if I was a dealer, and I was putting a deal together involving a product which is in demand (i am led to believe) it makes no sense to discount it, that would be silly.

So the part ex, which would have listed at 12.2 approx when new, and I am guessing you would have paid around 11 max, based on the deals that were available, the dealer has to buy from you and then retail at (hopefully) a profit. If I was the dealer I would want to be paying around 9 and hopefully retailing around 10. Any more than that, I would expect a punter to take advantage of the finance deal on new stock, all IMO of course.

I personally think you are doing well at 10k, so fingers crossed for you mate.

It is not really worth getting legal for the sake of a grand, no matter how annoying it is. Just take your money elsewhere. Something will turn up, it always does.

I suppose what you have to ask yourself is how bad you want an SP? Being limited and harder to get hold of do you go against all principles and trade at 9k or if you can live with out one tell them where to shove it !

It would stick in my throat to give that company a profit. I was in business for many years, and my word was always my bond, even if it meant me loosing money on a deal. Shame on them. I am sure the best will come of it for you in the long run. Take your time with a decision, there's also another deal.
    Good Luck,
    Mike.

Yes you would think a lot would end up racing - presume they qualify for IOM TT Superstock etc.?

Looks like the journalists have nicked them all!

Hope you get sorted Graham - not good if they have agreed a price and then dropped it down by a grand.

Hopefully Honda will bring some more in after the initial batch. I talked to my local dealer and they said they are only getting 2 (and may keep 1).

    Cheers,

    Ian.
