A couple of weeks ago coming upto a set of traffic lights on red I was filtering down the right hand side of the queue when a high ranking member of the police force decided to pull out on me. scratches on the side panel and clutch lever. At the scene he admitted liability and I also have this on e-mail but his insurance company are denying he is responsible. Any ideas.
They will always try and deny it. Just set your insurance company onto them. Don't forget you will need a hire bike whilst your's is repaired.
You have to love insurance companies don't you. "Yes Mr Wurzel you do pay an insurance premium but you surely don't expect us to get off our fat arses and do our job do you!"
If he has admitted in email that he is liable then forward to to his insurance and remind them that he admitted at the scene he was too, you would have to pay the excess anyway but your company should claim that back from the 3rd parties company, I would ask that it goes to a honda dealer for the repairs rather than a general accident repair place.
My insurance company have told me get the work done and pay for it myself and they claim it back from the other side but my no claims takes a hit.
As you have reported it your no claims is history. As they like to say it is a no claim bonus not a no blame bonus. You will get you discount but it will be applied to a higher base premium, and you won't be able to tick the easy option on insurance renewal forms for five years. So make those buggers do the running around as you will have enough of it to do over the next 5 years. If they insist on you fixing it then get it in writing from them and then write to inform them you will be taking it to a Honda Main Dealer to get fixed, and that you will need a suitable replacement loan bike for the duration.
Your percentage and number of years will not be affected, however it will affect how the underwriters will assess your base premium. Next year when you renew get a quote with and without a no fault claim and compare the difference.
As Barstewarsquad says you will pay more next year My car got rear ended in December and written off no fault, my premium was £100 more a year with no fault on than no accident for an accident that I had nothing to do with other than gritting my teeth and awaiting a Big Bang from the rear So in most respects it was very much like dealing with insurance company's
Your insurance company sounds like a bunch of half-wits, what exactly are you paying for ? Yes your base claim will be adversely affected but they should still be dealing with it for you and contacting his insurance company to tell them to roll in their necks as their client has admitted fault in an email ! This sounds a real simple claim, but they appear to be making it anything but.
There is a mind set out there that try to put the blame on bikes filtering which is wrong. Filtering is legal. If the plod have admitted liability your insurance company should deal with everything at no cost to yourself. You were not at fault They might try to get out of it but it is their responsibility to put you back on the road not yours which includes a hire bike. Your no claims should not be affected but as said your premiums will go up. It's wrong time wrong place

As explained to me by my insurance company last year when I was involved in a bump, your better having a "fault" accident on your history rather than a "non fault". Their reasoning was that as you already had an accident the cost was known. Whereas if it wasn't your fault then the probability was that the next one would be your fault and as the cost of this, as yet imaginary, accident was not known, they would estimate its cost as potentially far higher. Therefore your premium increases more for a non fault than a fault claim. Still sounds complete bollox to me but just shows how they change the story to suit themselves.:-((
Thanks to all. Apparantly they have 90 days from the date of being informed to decide if they are liable so it looks like I am going to have to sit it out.
That sucks mate had something similar with the car few years back not my fault even had witnesses but the insurance company's ended up agreeing with a 50/50 fault and wouldn't budge. Got to love them not.
Don't accept the runaround from your insurance company,they should be handling everything,including a hire bike if it wasn't your fault. I had a no fault claim where a young driver pulled out of a junction and hit my swingarm,god knows how i managed it but the bike didn't go down. She admitted liability and i had a hire bike within 48hrs. My bike was left with the honda dealer for the insurance to sort out. Her company wanted to make me an offer for the damage or have the swingarm sprayed,both unacceptable in my book,as the bike was only 3 months old. My insurers did the trick and 5 weeks later (i'd told the dealer to take his time as i was enjoying riding the hire bike coming into winter) had a new swingarm,bearings etc. No loss of no claims or sleep and my premium still came down the following year
i do really wounder why we even bother with insurance companies, there jobs to protect you again losses....... but don't want the hassle to do it. i think they should be named and shamed on here for poor customer service. i feel for you cause i had a huge hassle with a non fault in the car.... took about 12 weeks to solve. mine was a write off and you never got the same money as it cost to replace
