I've been caught doing 60 in a 40 zone on the m1 stretch. I'm not even sure it was me or someone else but just wanted to take opinion ... I have been doing considerable mileage up and down the m1 due to father in law being dignosed with cancer and was wondering if this would be considered as exceptional circumstances ??? I always follow the speed restrictions and don't recall 40 mph on this stretch of road but easy to go over when travelling at night when the road is quite Problem is if it was me then that could take me to 12 points which is very problematic ... Any thoughts on this problem ?
You'll probably get done as they rarely care why you were speeding, but you could try saying that a ban would cause issues* with being able to visit the father in law, especially if the missus doesn't have a licence etc. 12 points doesn't have to mean a ban. *There is a phrase which I can't remember that is better to use than "issues" but a solicitor or pepipoo should be able to tell you better.
the very useful 5ive-o forum seems to have died, but I'd suggest getting some legal advice. Avoiding 12 points might not be an option... but you may be able to avoid a ban by saying the right things. Also, try and get advice on whether joining IAM/Rospa etc, or doing some bikesafe training would show initiative towards not getting further points, and if it would be something a court would look favourably on. Although you said in your original post "I always follow the speed restrictions", magistrates might not believe that you're always an angelic rider/driver because your license is close to 12 points. Thanks guys, as it turns out I am the "legal" driver and it's my mrs that's the nut job speeding around. Luckily it's only the one nip and as the mrs has a clean licence it is all acceptable. However the good old days of enjoying a drive across the country on a motorway are disappearing fast. Smart motorways, variable speeds do work in controlling traffic flows but to have them "active" without warnings is a blatant piss take. Need a smart app that tells you when your approaching an active camera !!
Read this months fast bikes article on specs in three years time all motorways will be aquiped with them no escape for bikes
yuk. I don't mind cameras in accident hotspots or roadworks... or even the occasional police officer with some room for discretion. Cameras all over the place is a bit much
I read an artical a few years, the police would like all vehicles to be fitted with trackers so they can track there speed 24/7, motorways are getting there already it seems
Scameras rarely pretend these days to be "safety" related. There used to be criteria which had to be met before they were allowed to put one up, but now they use more mobiles and put them where they want. The Highways Agency deploying HADECS 3 shows the future where non law enforcing organisations put cameras wherever they want, in the same way that the cameras for active management went from only being active when the speed limits were changed, to being active whenever they want and started zapping drivers at 75 mph. As for the Police, well I'm sorry but they are a shadow of their former selves and are only interested in doing as little as possible, and would much prefer technology to tell them when people are speeding rather than getting off their lazy arses and actually police the roads for the numerous other offences that they can not detect remotely such as mobile use and drink driving.
They will struggle on that due to permitted errors and tolerances. As far as I am aware ACPO still give tolerance suggestions, but they are suggestions. It's only the 20 zones where they say not to give any leeway.
Doing 83 mph on Cruise control has served me well for years on free running M Ways Setting said Cruise at 55 in the 50 mph 'Works' zones and also the variable limits etc on the M42 etc also seems to be fine. This allows for Speedo under-reading and the allowable tolerances over the set limit
There are long time road works with average speed camera's on the A14 during my commute to the office. Two set at 40 and one at 50. I always set the limiter on my car at 10% higher and so far no issues.
The margin of error always used to be +10% + 3mph. So they could only bust you in a 70mph if their equipment registered 80 or more. 36 in 30, 47 in a 40 etc...
