Yet a speeding Bikers who caused no injuries to other road users get 2 years in prison? An off duty policman "testing" an unmarked car and showing No "Blues and Twos" caught doing 157mph, no charge? A bin lorry driver with history of black outs kills 7 and walks away free? This country needs to have a serious looks at its justice system
Saw this and can't believe that no other cameras got the driver's face. Bet they would have if it had been really serious like speeding or driving in a bus lane.
It is because the CPS are weak and do not like a fight. They have previous for losing evidence (an armed robber walked free many years ago because the CPS could not find the file) and I have dealt with many fatalities where I provided the evidence and was prepared to go to court and let the jury decide if someone was guilty of death by dangerous driving, but te CPD decided to plea bargain accept a plea for careless driving and in the mind of the CPS everyone would be happy because they have a result. In respect of fatal crashes, it has nothing to do with the fact that someone has died, in fact the death is taken out of the equation when the determination is being made (whch may appear harsh), it all comes down to the evidence of what can be proved, after all in 99.9% of fatal crashes, nobody goes out with the intention of killing someone, in most cases it is a case of someone suffering a momentary lapse in concentration which results in distastrous consequences. In the 0.01% of cases we do have vehicular manslaughter which is very difficult to prove compared with death by dangerous and there are some where the drivers standard of driving (or riding) is so appalling, a fatal crash is inevitable, but in the 1,000+ fatal crashes I have either attended or dealt with, in the majority of them it has been the moment of inattention that has resulted in the crash, and that is what the convction and subsequent fines, penalties and/or disqualifications are based on, not the fact that someone has died. In this case, the hire car driver was fined for failing to notify the driver which is a petty offence an there probably is evidence out there (cctv or whatever ) that could have identified the driver, (there were apparently 2 potential drivers) or.......Prosecute both of them and let the 2 drivers argue the point and if neither cough up, then both end up with the points. There was certainly enough evidence from what I have seen to prosecute for a minimum of careless driving
the clip only shown the ending of the event and not what led to it. From my own experience, the new breed of cyclist are their own worse enemy. They show no respect for other road users and pedestrian. On the open road they are million times worse than caravans and tractors. By default, I have no to little sympathy for these cyclist. They think it is their god given right to do whatever pleases them and they always come first me- me- me. I cycle a lot myself, I make sure I do not interfere with motor vehicles or irritate them if I have to use the public highway (same scenario as if I had to walk along the road)
I agree with everything you have said, but regardless of what may have gone on before, 2 wrongs don't make a right and if something had gone on before that does not give him (car driver) the right to play vigilante or ram the cycle up the rear
My take is that cyclist who put camera into every orifice of their bodies or bikes are out to enrage others and look for trouble. Specially as they are kindly allowed on the main highway sustained and paid for by motorists. On a different note let's not jump to conclusion maybe the cyclist suddenly cut in front of the car or the driver was busy watching you tube.. who know
Yeah and maybe the cyclists also have cars and Motorbikes, thereby paying the same road tax as other road users...
Whether the cyclist did anything wrong to start with isn't really relevant, you don't hit a cyclist with a 1 1/2 ton vehicle! Am pretty sure the driver would be up in arms if that had been done to a member of their family
