    the newer hand held one's take a pic now so tc is right, but im guessing they need to fix it on u for about 3 sec, my mate told me the ones in the vans need to be on u for 3 sec, he was looking for a sim reason, so cant see hand held being any diff, I agree with the bus getting in there way

    I don’t know how you know this, but I’d have to say you are wrong.

    unless england it’s breaking the technological barrier, here in N.i it’s stopped on the spot or nothing.

    Plus EVEN if there was a chance of it taking a blurry picture of the front of your bike.. you don’t have a plate on it.

    If I was you I’d be more concerned on the fact you started this thread, I’m no O.A.P and I love speed as much as the next guy but time and place for everything and somewhere bus’s stop isn’t one of them!

    Huh? Is that to suggest that a O.A.P. who has been licensed for 50-plus years is categorised differently, and by inference - of lesser ability, amongst our younger riding fraternity?

    Firstly, there is no requirement for a picture to be taken.

    Secondly, a Traffic cop is deemed an expert in regards of speed, and is one of the few offences where evidence of opinion is allowed, and he is allowed to note the speed and then write down the registration number as the bike goes past.

    But based on your comment, you are telling me that during my 25 + years of Traffic policing, I was doing it all wrong and that the hundreds, maybe thousands that an NIP was sent to rather than me stopping them (which included motorcyclists )at the time was illegal and wrong ?

    I am shocked and dissapointed that I got it so wrong for so long :(

    Thank you for putting me straight and pointing out the error of my ways. :)

    Maybe the rules are different in Northern Ireland, but I have regular contact with former colleagues in Traffic policing over there, and they have never suggested that the rules are that different even there, although like Scotland, there can be some minor differences in procedure.

    Speeding pass a parked bus is never a good idea at anytime, never mind on a regular basis!

    Hazard perception should have kicked in at some point but I guess that will come as you gain experience!

    I don’t remember reading that anywhere?

    I did however enjoy reading your sarcay and boastful reply of 25+ years in traffic policing.

    Also did I say that a NIP was illegal or wrong? Don’t remember writing that either.

    What I did however say is that it’s your word against theirs. Whether you’d win or not is another matter.

    If you are not stopped at the time who is to say you were driving the vehicle at all? Potentially someone had stolen your keys whilst at work taken your car for a joy ride and left it back again? Or as dealer mechanics sometimes do, take it for a spirited test ride?

    No no I just mean I’m not old enough to preach to others about speeding on the rode. As seen in previous posts there are numerous people with much more experience than myself.

    I do however drive EVERY DAY for a living, clocking up to 500 miles a week sometimes closer to 1000 miles.

    I understand a time and place for speeding

    I could clearly see who got in and out of the bus just couldn't see exactly after it..also the road is wide..i was well away from it when going past..empty road on the other way so I had plenty of choices to react if something was to pop up...I agree I was wrong..and no I don't go past the bus on a regular basis just the bus station..

    And yes they pretty much don't need any kind of evidence..but he did look after me with the radar gun as I went past..they were laughing...I'm only praying they could be inclined to let this one go...but I can't bet on it. But yes I do question the fact that they were there..and 10 more cars maybe 100 meters ahead..and they don't stop me or anything ...from what I understand is they don't have to..but its the preferred choice..also I was not imposing any kind of risk on them or the public so as to not stop me..because I was stationary waiting for them to come and slap the ticket in my face.

    Now can anybody answer to my one big question...after having 2 years on A2 and then upgrading to A licence.. do you start probation period again? Is my understanding that only the first category you get has a probation period.

    Also...in the meantime maybe this one you could answer with a bit more certainty, my ABS got worst..today on the way home...restart wouldn't cut it...and IT starts to flicker and yeah..idk whats happening to it..so I had to be really careful on the way home..and went as slow as I could. Now question is, I have to take it to Honda as part of the part-exchange ..this issue just arrived..I had no way of knowing..and seeing how I had friends take it there before..they won't test the bike other then starting the bike up..which there is no way of knowing the ABS has some issues...after I leave and its all set and gone..can they call me back and make me pay something? As far as I know..once you hand it and they sign...it is what it is..and not my business and no way to prove it was like that before.

    I go back to what you said. What you said was that a speeder HAS to be stopped. That is incorrect. You made a statement of fact. It does not matter if he was a traffic cop or not, at the end of the day it can pnly be operated by someone qualified and who has been trained. 99.9% of the time that is a traffic cop (whats left of them).

    Unless you were also being sarcastic, again that is an incorrect statement of fact.

    Again, wrong on all counts. The evidence that has to be provied by the Police is quite exacting and there has been plenty of case law about this which also covers Northern Ireland.

    Next you will be telling people that undertaking is illegal and that a Policeman following in a Police car with no camera fitted cannot report someone for speeding.

    So yes, I was being sarcastic because of all the incorrect statements of fact you have made which is of no help to the OP what so ever.

    Moderators, if I am wrong in the way I have corrected this guy, then please pull my posts and I will apologise.

    However, I suggest you actually learn about a subject before making so called expert incorrect statements of fact.

    If you have had your license 2 years or more you should be fine unless things have changed recently. Personally I doubt you will hear anything about this.

    So called expert, that would mean I classed myself as an expert. That’s what you done big guy! Im telling you now, without EVIDENCE this wouldn’t go anywhere.

    All I can say is I wouldn’t want to be a driver in england. Cops can just write down what they think you are doing on paper and That’s evidence enough.

    Taking a picture of a moving vehicle at speed with a handheld laser. Yeah would be breaking the technological barrier hence the reason for speed VANS with the space to house such equipment!

    Again..

    This is all circumstantial to the laws of 2 different countries in the same kingdom but hey, they are obviously completely different!

    We shall all agree to disagree and if insanity could keep us posted of when his NIP arrives or perhaps doesn’t that would be great

    tell honda theres nothing wrong with the abs just like they tell there costumers, i'd a thought they would service it b4 resale anyhow, bleeding the brakes part of it? only a thought

    Would the CPS be willing to take the case if the only evidence was a statement by a Copper? Not likely in this day and age.

    AFAIK no-one here is currently professionally qualified to state what the law is or not, or more importantly the current appetite for an unnamed Force to try and prosecute such a case.

    Whether CPS would take a case on such as this would depend on the Chief Prosecutor for the area. CPS will often choose to offer no evidence (even in fatal crash cases) than put up a fight.

    A statement by a copper is sufficient, bearing in mind that the little known offence of Speed Reckless can be reported based purely on the opinion of 1 traffic cop, but this offence has not been used for years.

    99.9% of speed offences are prosecutedon the basis of 1 policemans statement corroborated by either -

    Certified speedometer (3/10 of a mile follow on normal roads, 1 mile follow on a Motorway)
    VASCAR
    Lazer
    Muniquip (Replaced by lazer but still valid equipment)
    Truvello (cables across the road)

    All devices have to be callobrated and certified which is why if a Panda car does a following check and books a driver, the speedometer has to be checked against an approved device as soon as possible afterwards as they do not have callibrated speedo heads.

    I can assure you that some forces do still have the appetite to try it on, especially the forces who have large sections of Motorway, and I still get asked from time to time to give evidence on behalf of someone who has been reported by a single Policeman. But as far as having the appetite is concerned, some forces are more traffic orientated than others.

    My only professional qualification is that this is an area of law I am still involved in, albeit not my main area of law.
