    Apparently he is defending Beckham on a speeding charge. Not much interesting there apart from the defense is that the NIP was delivered 1 day past the 14 stipulated.

    I thought this had already been sorted as a Judge previously said that 1st Class post always arrived the next day, so it will be fun to see the outcome of this as it may reduce that wait for the letter through the door that many of us have experienced.

    Yeah, how is he going to prove when the letter fell onto his mat? ...or is that the point, that he is stating that the 'prosecution' must prove it was delivered in a timely manner o_O

    I though they no longer had to deliver within 14 days, I believe it was changed to that the NIP must be produced with 14 days and delivered within a timely manner
    But I stand to be corrected

    Judge has just chucked that out & said there's a case to answer! 4 witnesses called to prove it was sent by 1st class correctly

    I can see decision this being appealed. If te CPS have the gumption and the guts to go down that route.

    As you know, @T.C , one of the main criteria to appeal a matter such as this is whether it is in the 'public interest'. My view is that it is, otherwise every Tom, Dick and Harriet will be launching what might be termed frivolous actions. Not being privy to the elements of the case though, there may be more to this than just the 'day late' notice.

    Will be interesting now to see if the law gets amended if they revert back to using recorded/registered post.

    Given the cost of the latter I expect the former to be the most likely result.
