Was involved in an accident on this weekend..with the family...hit from the rear. Kids complaining about back pains. Talking to the insurance company - they are saying I can not discuss my kids claims..and it needs to be someone other then me or my wife..?? Conflict of interest! In the end they said my wife can deal with them...but not me.. Is this right?
Your kids will have what are called litigation friends if they are under 18. That can be you or your wife, but once apointed they will usually only talk to the appointed litigation friend But to say it has to be someone other than you or your wife is total cr@p. What are the nature of the injuries (if you do not mind me asking?) This is the area of law I now work in and I will be delighted to help if I can.

They will be the claims management companies who the insurers will want you to use on the basis that they can get rid of your claim quickly and cheaply. You are not obliged to use them. Your wife will be the preferred choice as your kids litigaton friend as there can then be no argument regarding what is called a conflict of interest, but the reality is that it is only a paper excercise and in any case you are claiming off the vehicle that rear ended you.
